§ 1
GENERAL PROVISIONS
The contest is organized under the name "Mennica Skarbowa – Exhibition of the Sistine Chapel in Krakow" on Facebook https://www.facebook.com/mennicaskarbowa.sa and is hereinafter referred to as the "Competition."
1. The organizer of the Contest is MENNICA SKARBOWA SPÓŁKA AKCYJNA, located at: Ulica Jasna 1, 00-013 Warsaw, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division – National Court Register under KRS number: 0000391546, NIP (Tax Identification Number): 7010307347, REGON (National Business Registry Number): 142951136 (hereinafter referred to as the Organizer).
2. The organizer of the Contest is ITBC Communication, a limited liability company with its registered office in Warsaw, at Aleja Księcia Józefa Poniatowskiego 1, 03-901 Warsaw, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division - National Court Register, under KRS number: 38209, NIP: 1132232133, REGON: 016301290 (hereinafter referred to as the Implementer).
3. The rules of the Contest are contained in these regulations (hereinafter referred to as the Regulations). A link to the regulations is available on the Facebook profile of "Mennica Skarbowa S.A." in the contest post, address: https://www.facebook.com/mennicaskarbowa.sa
4. The Contest Organizer is responsible for ensuring that the Contest is conducted correctly and in accordance with the provisions of the Rules.

§ 2
TERMS AND CONDITIONS OF PARTICIPATION IN THE CONTEST
1. The contest runs from May 17, 2024, to May 22, 2024, until 11:59 p.m.
2. Any natural person who meets the following criteria may participate in the Contest (hereinafter referred to as the Participant):
a) has full legal capacity
b) is not an employee of the Organizer or Contest Administrator
c) is not a family member of an employee of the Organizer or Contest Administrator
d) has permanent residence or domicile in the Republic of Poland,
e) has read and accepted the Rules and Regulations, whereby posting the competition entry on the Facebook social networking site https://www.facebook.com/mennicaskarbowa.sa is tantamount to reading and accepting the Rules and Regulations;
f) has consented to the publication of the Competition entry on the Organizer's websites or social media profiles. Participation in the Competition is conditional upon the fulfillment of all the conditions specified in section 2 above.
3. The competition task is to write a response to the question under the competition post: Who would you take to the exhibition "Sistine Chapel. Heritage" and why?
4. The Competition Entry should be posted in the comments section of the competition post on the Facebook profile of the "Mennica Skarbowa S.A." campaign. https://www.facebook.com/mennicaskarbowa.sa
5. The contest is open to anyone who has viewed the Facebook profile https://www.facebook.com/mennicaskarbowa.sa and it is recommended that Participants follow the profile before entering the Contest. However, not following the profile does not exclude the Participant from participating in the Contest.
6. Each Participant may submit any number of Competition Entries to the Competition. Competition Entries may only be submitted during the Competition period and must comply with the Competition task. It is prohibited to submit Competition Entries that are unlawful or inconsistent with the Competition Rules; in particular, it is prohibited to submit Competition Entries that are erotic, pornographic, commonly considered vulgar, offensive, or obscene, violate both Polish and international legal and moral standards, depicting or promoting violence, hatred, discrimination (racial, cultural, ethnic, religious, or philosophical, etc.), violating personal rights or offending the dignity or feelings of others (including religious and political), as well as those of an advertising, commercial, or promotional nature.
7. It is prohibited to submit works that you are not the author of or for which the author has not given consent for publication. Participants whose Competition entries give the Organizer or Implementer reasonable grounds to doubt their ownership of the copyright may not receive a prize in the Competition.
8. The Organizer has the right to remove from the website any Competition entries that violate the provisions of the Rules.
§ 3
AWARDS
1. The prizes in the Contest are funded by the Organizer.
2. A total of no more than 10 Contest Participants whose works are deemed the best by the contest committee appointed by the Organizer will be awarded. Each Participant may be awarded only once.
3. The prizes in the competition are 10 double golden tickets to the exhibition "Sistine Chapel. Heritage" in Krakow. The golden ticket can be used at any time and at any hour, from the dates available for sale.

The exhibition organizer, MANUSCRIPTUM spółka z ograniczoną odpowiedzialnością, with its registered office in Warsaw, KRS: 0000654355, NIP: 525268705, is responsible for the proper execution of the tickets.
4. In order to ensure the proper organization of the Contest, the Organizer shall appoint a contest committee. Any doubts regarding the rules of the Contest, interpretation, and provisions of these Regulations shall be resolved by the Organizer.
5. The winners of the Contest will be selected within 3 business days from the end date of the Contest. The winners of the Contest will be notified of their win in a comment under the contest post on the Facebook profile https://www.facebook.com/mennicaskarbowa.sa
6. The Organizer will be responsible for delivering the prize to the Winner. In order to receive the prize, the Winner must provide the following information in a private message on the "Mennica Skarbowa S.A." Facebook profile: first name, last name, shipping address, email address, PESEL number, and telephone number. Prizes will be sent by courier within 14 business days of the announcement of the Contest results.
7. In order for the prize to be sent to the winner of the Contest, the winner must first complete, sign, and return a scanned copy or clear photograph of the prize acceptance form, which the Organizer will send to the winner. The winner of the Contest is required to provide personal data in the receipt protocol, as stated in their identity document. At the same time, the address of residence or registered address indicated by the winner of the Contest must be the address that is locally appropriate for the winner of the Contest for settlements with the Tax Office.
8. Failure of the Competition winner to respond within 2 business days of the date of sending the message referred to in section 7 above, refusal to talk or refusal to provide the above-mentioned information necessary to deliver the prize shall be tantamount to waiving the right to receive the prize and waiving any claims against the Organizer and the Implementer related to the awarding of the prize.
9. The Organizer and the Implementer will supervise the proper conduct of the Contest.
10. Pursuant to Article 30(1)(2) of the Personal Income Tax Act of July 26, 1991 (consolidated text: Journal of Laws of 2012, item 361, as amended), the prizes referred to in § 3 of the Rules is subject to a flat-rate personal income tax of 10% of the value of the prize. The Organizer, as the payer of the flat-rate personal income tax, shall calculate, collect, and pay the flat-rate income tax due on the prize to the relevant Tax Office before awarding the prizes to the Winner. For this purpose, a cash bonus corresponding to the flat-rate personal income tax on the prize won in the Competition, amounting to 11.11% of the value of the prize, will be added to the value of the Prizes. The Participant declares that if they become a Winner of the Contest and are to receive a prize, they agree that the amount of the cash bonus will not be paid to them, but will be used to pay the tax due on the prize won in the Contest.
§ 4
PERSONAL DATA OF CONTEST PARTICIPANTS
1. In order to participate in the Contest, the Contest Participant must provide true personal data, i.e.: first name, last name, PESEL number, e-mail address, shipping address - necessary for the Organizer to deliver the prize and pay the tax on the prize on behalf of the Contest Winner.
2. By entering the Contest and accepting these Rules, the Participant consents to the processing of their personal data by the Organizer and the Operator. Personal data will be processed solely for the purposes of: conducting the Contest, awarding the prize to the Winner, verifying identity, and paying income tax on the Prize to the Tax Office. The Participants' personal data will be protected and processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("GDPR") and in accordance with the relevant provisions of national law.
3. The administrator of personal data obtained as a result of the Competition is MENNICA SKARBOWA SPÓŁKA AKCYJNA, located at Ulica Jasna 1, 00-013 Warsaw, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division - National Court Register under KRS number: 0000391546, NIP: 7010307347, REGON: 142951136
4. Participants' personal data will be processed by the Organizer solely for purposes related to participation in the Contest, i.e.:
1) for the purpose of organizing and conducting the Contest, i.e., for the purpose of conducting the Contest in accordance with the Rules, i.e., performing the agreement in this regard, pursuant to Article 6(1)(b) of the GDPR, including selecting the winners, announcing the results of the Contest, awarding prizes in the Contest, sending the Contest prizes, and considering any complaints;
2) in order to pursue the Organizer's legitimate interest in pursuing or securing claims or defending against claims (pursuant to Article 6(1)(f) of the GDPR);
3) fulfilling the legal obligations incumbent on the Organizer, including as the founder of the prizes, pursuant to Article 6(1)(c) of the GDPR (e.g., accounting and tax obligations).
5. Participants' personal data will be processed for the period necessary to conduct the Contest, i.e., until the end of the Contest as specified in the Rules, and thereafter for the period of limitation of any claims and for the period required by law, including tax law and accounting regulations. In the case of processing personal data for purposes arising from the Organizer's legitimate interests, until the Participant objects to the processing of data. In the case of data processing for the purpose of fulfilling the Organizer's legal obligations, for the period specified in the relevant legal provisions.
6. Contest participants have the right to access their data and to rectify, delete, or restrict its processing, as well as the right to object, request the cessation of processing and transfer of data, and the right to lodge a complaint with the supervisory authority (the President of the Personal Data Protection Office).
7. Notwithstanding the above, the Participant has the right to object at any time to the processing of their personal data for direct marketing purposes.
8. Providing personal data is voluntary but necessary in order to participate in the Contest. Failure to provide personal data may result, depending on the case, in the inability to participate in the Contest or the inability to ship prizes.
9. Providing data is not a statutory or contractual requirement, but failure to provide it will result in the inability to conduct the Contest for such Participant and the inability to award them a prize.
10. The recipients of the Participants' personal data may be entities cooperating with the Organizer, processing them on behalf of the Organizer, including the Implementer, IT service providers, including those operating the Organizer's IT systems, marketing agencies supporting the Organizer in the implementation of the Contest, and entities delivering prizes to the winners, such as postal operators or couriers.
11. The data provided by Participants will not be subject to profiling or automated decision-making. The Organizer will not transfer the Participant's personal data to a third country or international organization.
12. By submitting their work to the Competition, participants agree to the publication of their work in all media and communication channels of the Organizer (e.g., on the website https://www.mennicaskarbowa.pl/ ), including social media (e.g., the Instagram profile https://www.instagram.com/mennica_skarbowa_sa/ and Facebook profile https://www.facebook.com/mennicaskarbowa.sa
§ 5
FINAL PROVISIONS
1. The Organizer reserves the right to amend these Rules and Regulations, provided that this does not adversely affect the conditions of participation in the Contest. This applies in particular to changes in the dates of individual Contest activities.
2. By entering the Contest, the Participant is obliged to act in accordance with the provisions of the Rules and applicable law.
§ 6
STATEMENT
By publishing their Competition entry, participants declare that:
1. The material created in connection with the performance of the competition task does not in any way violate the provisions of applicable law or any rights or personal interests of third parties, and the copyrights to these works are not limited or encumbered in any way.
2. I bear full legal responsibility towards the Organizer and the Contest Operator for any untruthful statements specified in section 1 above, and I undertake to release the Organizer and the Contest Operator from any liability within the scope of this statement, in particular in the event of any third-party claims, including through legal action, by third parties with claims resulting from the violation of their rights.
3. If his Competition entry is selected and he is awarded a prize, upon being informed of the award in accordance with the Rules, he shall transfer, without additional remuneration, the economic copyright to the work in the following fields of exploitation:
a) recording and reproduction by printing or similar techniques;
b) publishing and distributing in all editions, regardless of form, standard, system, or format, without limitation on the number of print runs, editions, and copies; this also includes the right to partial or complete reprinting (before and after production), including photocopies, as well as other forms of reproduction;
c) entering such records into a computer memory and making copies of them for operational purposes, as well as permanent or temporary reproduction of the computer record in whole or in part by any means and in any form;
d) use for marketing purposes, including advertising, promotion, labeling, or identification, also on social media channels and on the Organizer's website; this also includes recording and printing, as well as the use of these recordings;
e) making it available to the public in such a way that anyone can access it at a place and time of their choosing, including via any electronic, digital, or other public communication channel;
f) placing on the market, distribution of copies and reproductions thereof.
§ 7
1. The contest is not affiliated in any way with Facebook or entities holding rights to Facebook, therefore any claims related to the contest should be directed to the Organizer, not to Facebook.
2. The Organizer and Participants (in the case of using Instagram) are required to comply with all Facebook regulations when organizing the Contest, and any violation of Facebook regulations constitutes a violation of the terms and conditions of participation in the Contest.
3. The contest is not a game of chance, raffle, mutual betting, promotional lottery, game whose outcome depends on chance, or any other form provided for in the Act of November 19, 2009, on gambling (Journal of Laws 2023.227, i.e. of February 2, 2023).
4. Terms and Conditions:
1) shall apply only to the extent that it does not violate mandatory or semi-mandatory provisions, and if any provision proves to be inconsistent, the relevant provisions shall apply in place of such provision,
2) determines that the Contest shall be conducted in full, with the proviso that matters not covered by these Rules shall be governed by Polish law. Materials other than the Rules are for informational purposes only.
